Independent contractors are coming together to share their stories with local media. It is important we show lawmakers how many Orange County independent contractors and small businesses are impacted by the Dynamex ruling.

The California Supreme Courts April 2018 decision regarding Dynamex completely changed the way in which an individual is classified an independent employee in this state. Its impacts are being felt by businesses using contract labor as well as independent contractors.
Under the Dynamex decision, an individual must satisfy all three factors of the ABC Test:
- That the worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact;
- That the worker performs work that is outside the usual course of the hiring entity?s business; and
- That the worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed.
